When and How to Apply to Strasbourg
The application requires having exhausted domestic remedies—normally including the amparo appeal—and must be filed within the Convention deadline. The ECHR is not a new instance: it reviews whether the State has violated a right under the European Convention on Human Rights, frequently the right to a fair trial under Article 6.
