What is a Red Notice and what is it not?
A Red Notice is a request for location and provisional detention that a country disseminates through Interpol with a view to extradition. Alongside it exist diffusions, alerts that a State sends directly to others without going through Interpol’s prior filter. Neither is, technically, an arrest warrant; but in practice they block travel and banking operations. Interpol’s own Statute prohibits notices of a political, military, religious, or racial nature (Article 3), and this is one of the main grounds for challenge.
What we do, step by step
Our intervention covers the entire procedure before the Commission for the Control of Interpol’s Files (CCF):
- Data access request. We ask the CCF to confirm whether data exists in your name in Interpol’s files and what information it contains.
- Correction request. When the data is inaccurate or incomplete.
- Deletion request. The core of the work: we request the deletion of the notice or diffusion, based on non-compliance with Interpol’s regulations and human rights standards.
- Preventive measures. We work on preventing border detentions while the procedure progresses.
Expertise and international network against Interpol abuse
We are members of Lawyers Against Transnational Repression (LATR), the international group of lawyers defending those subject to abusive requests through Interpol, extradition, and judicial assistance. It includes, among others, leading figures such as Yuriy Nemets and Anna Oehmichen. This network gives us access to the best CCF case law and real coordination with lawyers in the country that originated the alert, to address the cause at its source and not just its effects.
Common mistakes to avoid
- Submitting a poorly substantiated request to the CCF: it can be counterproductive and hinder a second attempt.
- Ignoring the diffusion and focusing only on the Red Notice: the diffusion also affects you.
- Traveling without first verifying, through a data access request, whether data exists in your name.
- Addressing only the effect in Spain without dismantling the cause in the country of origin.
